Introduction
This privacy notice is provided pursuant to Articles 6 and 19 of the Swiss Federal Act on Data Protection (LPD) and the Data Protection Ordinance (OPDa). It informs you about how we collect and process your personal data in connection with the sending of our newsletter.
This notice is issued by BSA Swiss SA in its capacity as the Data Controller pursuant to Article 5 letter j of the LPD.
What information do we collect, for what purposes, and on what legal grounds?
BSA Swiss SA will process the personal data collected and/or provided through the Website and/or during the pre-contractual and/or contractual phase in accordance with the methods and for the purposes described in this section.

Personal data provided at the time of newsletter registration, such as:
- E-mail address;
Purpose of Processing
Sending of newsletters and informational or promotional communications regarding:
- Products, services, or special offers from BSA Swiss SA;
- Business updates, promotions, and events related to products or services similar to those previously purchased.
Legal Basis
- Consent pursuant to Article 6 cpv. 6 of the LPD, expressed through voluntary subscription to the newsletter;
- Existence of a previous business relationship with BSA Swiss SA (Article 31 cpv. 2 lett. a of the LPD).
Data Retention
The personal data processed for the sending of the newsletter will be retained in accordance with the principles of purpose limitation and proportionality set out in the LPD, in the following ways:
- Until the revocation of consent by the data subject, which can be exercised at any time via the opt-out provided in each communication received or by directly contacting the Data Controller.
Methods of Processing
The processing of personal data will be primarily carried out using electronic or automated tools, in compliance with the principles of security, proportionality, and good faith set out in Article 6 of the Swiss Federal Act on Data Protection (FADP).
In accordance with Articles 7 and 8 of the FADP and Articles 1 and 3 of the Data Protection Ordinance (DPO), appropriate technical and organizational measures will be adopted to protect the data from unauthorized access, loss, unlawful use, or unauthorized disclosure.
The information collected will be relevant, proportionate, and limited to the purpose for which it is processed and will be stored in protected environments, accessible only to authorized personnel and subject to control.
Who do we share your information with?
Without prejudice to all communications required by law or necessary to fulfill contractual obligations, the personal data collected may be shared exclusively for the purposes indicated in this notice, including but not limited to:
- Employees and collaborators of the Data Controller, authorized to process personal data as part of their duties and subject to the security measures and access control provisions set out in Article 3 of the Data Protection Ordinance (OPDa);
- Individuals or legal entities who process data on behalf of the Data Controller (Data Processors pursuant to Article 9 of the LPD), such as IT service providers, hosting services, website maintenance, who process data according to documented instructions and based on a written agreement;
- Employees and collaborators of the Data Processors, if authorized and trained in accordance with the provisions agreed upon contractually, as persons operating under the responsibility of the Data Processor;
- Public authorities within the limits set by law or official decisions, where such communication is necessary to fulfill a legal obligation pursuant to Article 31 of the LPD.

Transfer of Data to Third Countries
BSA Swiss SA exclusively uses suppliers established in Switzerland or, exceptionally, in the European Union, and processes personal data in Switzerland or, exceptionally, in the European Union. Therefore, personal data will not be communicated to countries that do not provide adequate protection for data in accordance with Swiss and European law, except in cases where communication is based on the prior, explicit consent of the data subject or is required by law.
Your Rights and How to Contact Us
Pursuant to the Federal Act on Data Protection (LPD; RS 235.1) and the related Ordinance (OPDa; RS 235.11), data subjects may exercise the following rights:
- Right of access: to obtain confirmation as to whether or not personal data concerning you is being processed, and to receive information about the data processed and the methods of processing, in accordance with Article 25 LPD and Article 16 OPDa;
- Right to rectification: to request the correction or update of inaccurate or outdated personal data (Art. 32 LPD);
- Right to erasure: o request the deletion of personal data if it is no longer necessary for the purposes for which it was collected or if the processing is not in compliance with the FADP (Art. 32 LPD);
- Right to data portability: to obtain the personal data provided in a structured, commonly used electronic format, or to request its direct transmission to another controller, within the limits of Art. 28 LPD and Articles 20 and 21 OPDa;
- Right to object: to object to the processing of your personal data when such processing results in legal consequences or significant disadvantages, pursuant to Article 30 para. 2 LPD.

Right to Lodge a Complaint
If you believe that the processing of your personal data is in violation of the Federal Act on Data Protection (LPD; RS 235.1), you have the right to contact the Federal Data Protection and Information Commissioner (IFPDT), who is responsible for supervision and advisory activities pursuant to Articles 49 et seq. of the LPD.
You also retain the right to bring the matter before the competent judicial authorities, in accordance with applicable legal provisions.
Updates
The data controller reserves the right to modify, update, add, or remove parts of this privacy policy at their own discretion and at any time. Before using the Website or any related resources (email, telephone), it is therefore the user’s responsibility to check the current content of the privacy policy. To facilitate this verification, the policy will include the date of the latest update.
